The circumscribed quadrature of professional ethics aims to show the necessary shift from deontology to professional ethics, from deontological codes to ethical codes. While deontology and the deontological codes that materialise from it set their sights on professionals' responsibilities, professional ethics and the ethical codes that should derive from it would set their sights on the professional act, on its successful performance. In this way, the stress comes to be placed not only on the professional's responsibility, although that too, but (...) also on the necessary orchestration of the responsibilities shared at numerous levels by everyone involved in the performance of the professional act. The author identifies and typifies five elements present in the professional act. Four of them involve direct the protagonism of the professional, the recipient of the professional service, the institution that makes the service possible and from which the professionals' service is offered, and finally the human factor, the people who are behind the aforementioned factors and their nature, the professional, the recipient of the services and institutions. And each of these factors paves the way for a series of diversified protagonisms: inter-professional cooperation, receiver of professional services and their human environment around them, macro and micro institutions, diverse human profiles. However, all of this takes place within the framework of the fifth important element in professional ethics: a given, specific society as a circumscription of the four elements cited above, which sets the moral bar, a set of convictions and desired collective ethics which unquestionably also affect the performance of professional acts. With this reflection, we take note of the necessary co-responsibility in the provision of professional services, a co-responsibility which we could express simply in healthcare terms: it is not enough to merely have sound healthcare professionals if we do not have good patients with favourable affective environments, nor sound healthcare institutions, nor serious people who are socially committed to their work and their role, nor a society that believes in and fosters given identifiers of the personal and professional health to which we aim. The reflections in this proposal embark on a pathway of reflection which, we believe, deserves to be further explored. (shrink)

Katz (1981, 1985) has denied the psychological import of Linguistics on the grounds of alleged inconsistencies that arise when Linguistics is conceived as a psychological enterprise, and proposed an alternative Platonistic conception. The paper discards the plausibility of this latter approach to the study of natural language but recognizes the difficulties Katz has pointed out. It is claimed that these difficulties appear if the “strong competence hypothesis” (Bresnan & Kaplan, 1982) is assumed, that is, if it is assumed that the (...) form of the speaker’s knowledge of language is that of a grammar. A weaker conception of the psychological relevance of linguisitic theories is proposed-one that avoids Katz’s difficulties, is more congenial to Chomsky, and clears the way for a fruitful cooperation between Linguistics and Psycholinguistics. The paper presents the territorial and axiological context and the peculiarities of the participatory project developed by the Polis Research Centre and the Bon Pastor Neighbourhood Association, as well as the first steps in the design of two interventions. The first intervention, the Wall and Party Walls in Rodriguez de la Fuente Square, is proposed within the framework of the sustainable development strategies of Barcelona City Council. Its main objective is to achieve thermal insula­tion of the affected dwellings, thus contributing (...) to the well being of the residents and to the reduc­tion of CO 2 emissions into the atmosphere. Besides, it is aimed to solve landscape discontinuity. In the lower part of the party walls, there is a wall, a kind of plinth that the residents have chosen as a site for the expansion of the work on the civic remembrance of the neighbourhood. There, the “Living Memory” space will be set up, reserved for interventions by children from the quarter’s schools through a work programme run in cooperation with them. The second intervention is the case of the centennial Mulberry Tree classified as a tree of local interest. In 2018, the mulberry tree suffered some damage from thugs who threw firecrackers inside. Therefore, the need was pointed out to reorganise the space around the tree in order to create dissuasive effects and preserve its integrity. These are preliminary studies to be discussed by the agents involved in the project: the Sant Andreu District, the IMPUQV (Institut Municipal del Paisatge Urbài la Qualitat de Vida), and the Bon Pastor Neighbourhood Association. This paper takes Franco's Spain to be a powerful case study for analyzing the ways in which power shapes science and technology and is shaped by them in return. Spain was the last country in Western Europe to establish closer links with any of the international cooperative institutions emerging after WWII. As such, developments internal to Spanish society were quite autonomous and relatively free from foreign influences. The paper focuses first on the brand new, powerful institution that the Francoist regime (...) created to promote scientific research under tight political control, the Consejo Superior de Investigaciones Científicas. Next it turns to applied science and technology, top priorities for the regime's state-supported programs of industrialization. They were implemented through the politically and financially powerful Instituto Nacional de Industria. Using diplomatic sources, the paper next argues that, until the late 1950s, Spain maintained substantial political and economic isolation essentially because the regime bet on autarkic policies and a model of largely isolated development. In this model, it was crucial for the regime to develop its own technological and scientific resources. Finally, the paper examines how the regime fostered a new Spanish identity in which science had a new role. (shrink)

A cross-cultural analysis of trust and cooperation networks in Northern Ghana (NGHA) and Oaxaca (OAX) was carried out by means of ego networks and interviews. These regions were chosen because both are inhabited by several ethnic groups, thus providing a good opportunity to test the cultural group selection hypothesis. Against the predictions of this approach, we found that in both regions cooperation is grounded in personal trust groups, and that social cohesion depends on these emotional bonds. Moreover, in agreement with (...) Fiske's notion of “evolved proclivities”, we also found two distinct kinds of trust networks, one for each region, which vary in terms of the degree of ethnic interrelation. This pattern suggests that social cohesion increases when environmental resources are scarce. (shrink)

Human Towers are one of the most representative traditional sporting games in Catalonia, recognized in 2010 as Intangible Cultural Heritage by the United Nations Organization for Education, Science and Culture. The objective of this research was to study the emotional states elicited by a representative performance of the colla de Castellers de Lleida. This research is based on an ethnographic case study, with mixed methods in which 17 key informants voluntarily participated. Participant observation was used; the data were recorded in (...) a field diary and oral sources. The content analysis was done using the Atlas.ti software. An SPSS database was also created. The statistical techniques were: Descriptive statistical techniques, cross tables with Pearson's Chi-square values. We also used a classification and regression trees to examine the predictive capacity of five independent variables of emotional states. The results reveal that the comments were mostly oriented toward well-being states, The internal cooperative logic of the Human Towers enhances the intense interpersonal relationships of socio-emotional well-being. In this long-awaited book, Antony Duff offers a new perspective on the structures of criminal law and criminal liability. His starting point is a distinction between responsibility (understood as answerability) and liability, and a conception of responsibility as relational and practice-based. This focus on responsibility, as a matter of being answerable to those who have the standing to call one to account, throws new light on a range of questions in criminal law theory: on the question of criminalisation, which (...) can now be cast as the question of what we should have to answer for, and to whom, under the threat of criminal conviction and punishment; on questions about the criminal trial, as a process through which defendants are called to answer, and about the conditions (bars to trial) given which a trial would be illegitimate; on questions about the structure of offences, the distinction between offences and defences, and the phenomena of strict liability and strict responsibility; and on questions about the structures of criminal defences. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution through which a liberal polity defines a realm of public wrongdoing, and calls those who perpetrate (or are accused of perpetrating) such wrongs to account. Material Engagement Theory is currently driving a conceptual change in the archaeology of mind. Drawing upon the dictates of enactivism and active externalism, it specifically calls for a radical reconceptualization of mind and material culture. Unpersuaded by the common assumption that cognition is brain-bound, Malafouris argues in favour of a process ontology that situates thinking in action. In granting ontological primacy to material engagement, MET seeks to illuminate the emergence of human ways of thinking through the practical effects of the (...) material world. Considering that this is a characteristic example of a pragmatic take on cognition, this contemporary theoretical platform appears to share a lot with pragmatism. As of late, scholars working at the intersection of philosophy, semiotics, and cognitive science have made important steps towards the rapprochement between pragmatism and externalism. Looking to contribute to this growing corpus of work, the present paper focuses on MET’s relation to the pragmatism of Peirce, Dewey, and Mead. Having elsewhere recognized the overlap and complementarity between Malafouris’ and Peirce’s theories in particular, I developed a pragmatic and enactive theory of cognitive semiotics that is suitably geared to trace the nature, emergence, and evolution of material signs. Therefore, besides noting some obvious historical connections, I hereby aim to establish the theoretical backdrop upon which this composite theory is supposed to function, while also exploring new potential avenues. Given that this cognitive semiotic framework can be seen as a pragmatic extension of Malafouris’ enactivist approach to archaeology, the current paper delves into MET’s theoretical underpinnings, seeking to complement its working hypotheses and concepts with philosophical notions and ideas advanced long ago. This synthesis ultimately concludes with a call for the reconceptualization of ‘representation’ as a heuristic concept. (shrink)

The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. The Anatomy of Neoplatonism was the crowning achievement of A. C. Lloyd, the distinguished scholar of late ancient philosophy. He offers a rich and authoritative study of this school of thought, which was highly influential not only on subsequent philosophy but also on Christian theology. His discussion ranges over metaphysics, epistemology, logic, and language, and reveals the fundamental structure of Neoplatonist thought; the book is essential reading for all who work in this area. At the beginning of Book X of his last work The Laws Plato turns his attention from violent and outrageous actions in general to the particular case of undisciplined and presumptuous behaviour in matters of religion: “We have already stated summarily what the punishment should be for temple-robbing, whether by open force or secretly. But the punishments for the various sorts of insolence in speech or action with regard to the gods, which a man can show in word or deed, (...) have to be proclaimed after we have provided an exordium. Let this be it: ‘No one believing, as the laws prescribe, in the existence of the gods has ever yet performed an impious action willingly, or uttered a lawless word. Anyone acting in such a way is in one of three conditions: either, first, he does not believe the proposition aforesaid; or, second, he believes that though the gods exist they have no concern about men; or, third, he believes that they can easily be won over by the bribery of prayer and sacrifice”. While a standard procedure in mental health internment facilities, physical restraint, as an extreme form of coercion in mental health, has been claimed to be abolished. Three sorts of arguments have been provided: an argument from dignity, and argument from informed consent, and a consequentialism argument. In this chapter we discuss these arguments and conclude that these arguments are not decisive to completely ban such forms of coercion. Restraint, in particular, may be justified in exceptional circumstances, where an imminent risk (...) for the personal integrity of anybody involved, including the person with the mental health problem. However, this sort of case is infrequent, while restraint is often the first option. This conclusion also suggests that much can be done to prevent reaching such extreme circumstances where coercion may be the only option. The discussion also clarifies how coercion should be carried out, when justified, making it supervised and as short as possible. (shrink)

The concept of randomness has been unjustly neglected in recent philosophical literature, and when philosophers have thought about it, they have usually acquiesced in views about the concept that are fundamentally flawed. After indicating the ways in which these accounts are flawed, I propose that randomness is to be understood as a special case of the epistemic concept of the unpredictability of a process. However, the rumour in some circles is that Flew - long-time advocate of atheistic humanism - has become a theist. Judge for yourself.

Recently, Cody Gilmore has deployed an ingenious case involving backwards time travel to highlight an apparent conflict between the theory that objects persist by perduring, and the thesis that wholly coincident objects are impossible. However, careful attention to the concepts of location and parthood that Gilmore’s cases involve shows that the perdurantist faces no genuine objection from these cases, and that the perdurantist has a number of plausible and dialectically appropriate ways to avoid the supposed conflict.

Illusions are thought to make trouble for the intuition that perceptual experience is "open" to the world. Some have suggested, in response to the this trouble, that illusions differ from veridical experience in the degree to which their character is determined by their engagement with the world. An understanding of the psychology of perception reveals that this is not the case: veridical and falsidical perceptions engage the world in the same way and to the same extent. While some contemporary vision (...) scientists propose to draw the distinction between veridical experience and illusion in terms of the satisfaction or non-satisfaction of “hidden assumptions” deployed in the course of normal perceptual inference, I argue for a different approach. I contend that there are, in a sense, no illusions – illusions are as “open” as veridical experiences. Percepts lack the kinds of intentional content that would be needed for perceptual misrepresntation. My view gives a satisfying solution to a philosophical problem for disjunctivism about the good case/bad case distinction: with respect to illusions, every "bad case" of seeing an X can be equally well construed as a "good case" of seeing some Y (different from X). -/- . Concern about two problems runs through the work of davidson: the problem of accounting for the "explanatory force" of rational explanations, and the problem posed for materialism by the apparent anomalousness of psychological events. davidson believes that his view of mental causation, imbedded in his theory of "anomalous monism," can provide satisfactory answers to both questions. however, it is argued in this paper that davidson's program contains a fundamental inconsistency; that his metaphysics, while grounding the doctrine of anomalous monism, makes (...) impossible a successful response to the problem of explanatory force in terms of a causal theory of action. Our view of heredity can potentially be distorted by the ease of introducing heritable changes in the replicating gene sequences but not in the cycling assembly of regulators around gene sequences. Here, key experiments that have informed the understanding of heredity are reinterpreted to highlight this distortion and the possible variety of heritable changes are considered. Unlike heritable genetic changes, which are always associated with mutations in gene sequence, heritable epigenetic changes can be associated with physical or chemical changes in (...) molecules or only changes in the system. The transmission of cycling stores along the continuous lineage of cells that connects successive generations creates waves of activity and localization of the molecules that together form the cell code for development in each generation. As a result, heritable epigenetic changes can include any that can alter a wave such as changes in form, midline, frequency, amplitude, or phase. Testing this integrated view of all heritable information will require the concerted application of multiple experimental approaches across generations. (shrink)

I sketch a new constraint on chance, which connects chance ascriptions closely with ascriptions of ability, and more specifically with 'CAN'-claims. This connection between chance and ability has some claim to be a platitude; moreover, it exposes the debate over deterministic chance to the extensive literature on (in)compatibilism about free will. The upshot is that a prima facie case for the tenability of deterministic chance can be made. But the main thrust of the paper is to draw attention to the (...) connection between the truth conditions of sentences involving 'CAN' and 'CHANCE', and argue for the context sensitivity of each term. Awareness of this context sensitivity has consequences for the evaluation of particular philosophical arguments for (in) compatibilism when they are presented in particular contexts. (shrink)

In this chapter, I’ll provide an introduction to the mathematics of probability theory.1 The philosophy of probability doesn’t require much mathematical sophistication, at least not to get a good grip on the main problems and views. Nothing in this chapter is particularly complicated, and even the mathematically shy should, with a little effort, find it easy to follow. I do assume familiarity with the basics of an elementary logic course, and some basic facility with the notion of a set.

Jerry Fodor has argued that concept acquisition cannot be a psychological or “rational-causal” process, but can only be a “brute-causal” process of acquisition. This position generates the “doorknob → DOORKNOB” problem: why are concepts typically acquired on the basis of experience with items in their extensions? I argue that Fodor’s taxonomy of causal processes needs supplementation, and characterize a third type: what I call “intelligible-causal processes.” Armed with this new category I present what I regard as a better response than (...) The current legal status and medical ethics of routine or religious penile circumcision of minors is a matter of ongoing controversy in many countries. We focus on the United Kingdom as an illustrative example, giving a detailed analysis of the most recent British Medical Association guidance from 2019. We argue that the guidance paints a confused and conflicting portrait of the law and ethics of the procedure in the UK context, reflecting deeper, unresolved moral and legal tensions surrounding child genital (...) cutting practices more generally. Of particular note is a lack of clarity around how to apply the “best interests” standard—ordinarily associated with time-sensitive proxy decision making regarding therapeutic options for a medically unwell patient—to a parental request for a medically unnecessary surgery to be carried out on the genitalia of a healthy child. Challenges arise in measuring and assigning weights to intended sociocultural or religious/spiritual benefits, and even to health-related prophylactic benefits, and in balancing these against potential physical, functional, and psychosexual risks or harms. Also of concern are apparently inconsistent safeguarding standards being applied to children based on their birth sex categorization or gender of rearing. We identify and discuss recent trends in British and international medical ethics and law, finding gradual movement toward a more unified standard for evaluating the permissibility of surgically modifying healthy children's genitals before they can meaningfully participate in the decision. Intuitively it has seemed to many that our concepts conscious state and conscious creature are sharp rather than vague, that they can have no borderline cases. On the other hand, many who take conscious states to be identical to, or realized by, complex physical states are committed to the vagueness of those concepts. In the paper I argue that conscious state and conscious creature are sharp by presenting four necessary conditions for conceiving borderline cases in general, and showing that some (...) of those conditions cannot be met with conscious state. I conclude that conscious state is sharp, and the conclusion is then extended to conscious creature. The paper ends with a brief discussion of some implications. (shrink)

I want to discuss philosophically, to glance at the logic of, the parts of this expression “the justification of punishment” and then to draw from this discussion one or two morals for discussions of the justification of punishment. This paper is based on one originally given to the Scots Philosophy Club at its Aberdeen meeting in 1953, as the third part of a symposium on The Justification of Punishment.

Gödel argued that intuition has an important role to play in mathematical epistemology, and despite the infamy of his own position, this opinion still has much to recommend it. Intuitions and folk platitudes play a central role in philosophical enquiry too, and have recently been elevated to a central position in one project for understanding philosophical methodology: the so-called ‘Canberra Plan’. This philosophical role for intuitions suggests an analogous epistemology for some fundamental parts of mathematics, which casts a number of (...) themes in recent philosophy of mathematics (concerning a priority and fictionalism, for example) in revealing new light. In this article I propose a new interpretation of Aristotle’s arguments about the authority of the many at Politics III 11, 1281a40–b21. It consists of the following main tenets. First, the multitude that Aristotle refers to in his arguments should be understood on the model of the multitude which rules in polities and the members of which are accomplished in only a part of political excellence, namely, military excellence. Second, the best citizens with whom he compares that multitude in his (...) arguments do not possess complete political excellence but rather the highest degree of military excellence among their fellow citizens in a polity. Third, the members of that multitude are collectively superior to the best citizens in making decisions about political particulars, for example, decisions about specific policies. Fourth, their superiority can be explained by reference to the fact that they collectively possess superior experience than the best citizens, though they have individually and collectively inferior political understanding. Finally, their collective superiority in making political decisions is the outcome of the aggregation of their individual political judgements that are based on experience rather than the outcome of some form of public deliberation that enables them to grasp the political reasons which support their decisions. The paper begins with the plausible view that criminal responsibility should track moral responsibility, and explains its plausibility. A necessary distinction is then drawn between liability and answerability as two dimensions of responsibility, and is shown to underpin the distinction in criminal law between offences and defences. This enables us to distinguish strict liability from strict answerability, and to see that whilst strict criminal liability seems inconsistent with the principle that criminal responsibility should track moral responsibility, strict criminal answerability is (...) not. This article explores the connection between objective chance and the randomness of a sequence of outcomes. Discussion is focussed around the claim that something happens by chance iff it is random. This claim is subject to many objections. Attempts to save it by providing alternative theories of chance and randomness, involving indeterminism, unpredictability, and reductionism about chance, are canvassed. The article is largely expository, with particular attention being paid to the details of algorithmic randomness, a topic relatively unfamiliar to philosophers.

Early work on the frequency theory of probability made extensive use of the notion of randomness, conceived of as a property possessed by disorderly collections of outcomes. Growing out of this work, a rich mathematical literature on algorithmic randomness and Kolmogorov complexity developed through the twentieth century, but largely lost contact with the philosophical literature on physical probability. The present chapter begins with a clarification of the notions of randomness and probability, conceiving of the former as a property of a (...) sequence of outcomes, and the latter as a property of the process generating those outcomes. A discussion follows of the nature and limits of the relationship between the two notions, with largely negative verdicts on the prospects for any reduction of one to the other, although the existence of an apparently random sequence of outcomes is good evidence for the involvement of a genuinely chancy process. Citizens and their Guests This brief editorial considers the significance of citizenship; the dangers of an exclusionary attitude towards non-citizens; the cosmopolitan response to such dangers, which denies any intrinsic significance to citizenship; and an alternative response that preserves the significance of citizenship as a matter of belonging to a genuine political community, but that also takes seriously both the need to welcome new citizens, and the status of non-citizens as guests.

The moral reinterpretation of Jesus conducted by Kant, Lessing and Feuerbach, is an interesting matter when it comes to the philosophy of religion. The abovementioned German philosophers claimed that Jesus ought to be understood only as a moral archetype and a revolutionist in morality. This concept arose on the grounds of moral religion which was one of the most interesting ideas of the Enlightenment. Thus, exploring this moral reinterpretation of Jesus is just an excuse to study the concept of moral (...) religion. Despite the fact that this idea is no longer current, it has immense influence on the contemporary philosophy of religion. In this paper we see that the answer of this question is affirmative. We prove this for Dco-algebras and as special case we obtain the result for Positive Implication algebras. First we give, without proof, the properties of Dco-algebras and S-algebras and their connection with Positive Implication algebras and Implication algebras. These results can be found in [T] and [IT].

Issues connected to the pair of notions of image and reality have been present in philosophy at least since Plato’s times. The main question that accompanies the mentioned notions concerns the relation between image and reality. Does image present reality adequately, or is it perhaps a sort of falsification? However, this question may have no sense, because, as it is claimed for example by Richard Rorty, there is no possibility to differentiate between image and reality. An interesting exemplification of the (...) mentioned issue is the philosophy of photography, where the question about representation takes the following form: does a photograph (as an image) adequately mirror given reality? The aim of this paper is to present the problem of representationalism and antirepresentationalism, first in the broad philosophical context (based on the example of Rorty’s considerations), and then in the field of the philosophy of photography (based on the example of Barthes’s and Flusser’s reflections). This article is based on the text of a talk at the University of Athens in October 2018, in which I drew brief cameo portraits of five historians who inspired me and whose lives I admire: David Herlihy (1930–1991), Michael Baxandall (1933–2008), Marino Berengo (1928–2000), Hans Baron (1901–1988), and Marvin Becker (1922–2004). It is difficult to find strong common methodological or ideological ground shared by all five. Their priorities were different, their guiding lights in each case came from an internal (...) dialogue between their own passions and the inspiration they received from teachers and readings, not by the methodological preferences that dominated the profession in their lives. What, in the end, left a deep imprint on me was their character. Their commitment was to ideas and to dialogue. National, religious, ideological, or methodological differences did not cloud their judgment of others, especially of young scholars. All five, growing up in the Fascist era, were portents of the more level tones of the liberal democracy that slowly, amid myriad obstacles, set root in the decades following 1945. (shrink)

Russell famously argued that causation should be dispensed with. He gave two explicit arguments for this conclusion, both of which can be defused if we loosen the ties between causation and determinism. I show that we can define a concept of causation which meets Russell’s conditions but does not reduce to triviality. Unfortunately, a further serious problem is implicit beneath the details of Russell’s arguments, which I call the causal exclusion problem. Meeting this problem involves deploying a minimalist pragmatic account (...) of the nature and function of modal language. Russell’s scruples about causation can be accommodated, even as we partially legitimise the pervasive causal explanations in folk and scientific practice. (shrink)
